Holiday Party RSVP

1. PARTICIPATION, ASSUMPTION OF RISK, AND RELEASE OF LIABILITY

I voluntarily permit the Participant to participate in Activities offered by or through Wayfinder Family Services.

I understand that participation in Activities may involve known and unknown risks, including illness, injury, property damage, disability, or death. I voluntarily accept and assume all risks associated with attendance at and participation in Activities.

To the fullest extent permitted by law, I release, waive, and discharge Wayfinder Family Services and its directors, officers, employees, agents, contractors, and volunteers from claims, demands, damages, liabilities, causes of action, or expenses arising out of or related to participation in Activities, including claims resulting from ordinary negligence.

I agree not to bring legal action against Wayfinder Family Services for matters covered by this release and agree to indemnify and hold harmless Wayfinder Family Services from claims arising from the Participant’s conduct during Activities.

I certify that the Participant is able to participate safely and that I have disclosed any relevant medical conditions, medications, allergies, dietary restrictions, behavioral support needs, accessibility needs, or activity restrictions that may affect participation.

The Participant agrees to follow all applicable Wayfinder Family Services policies, safety requirements, staff directions, and standards of conduct while participating in Activities.

I understand that Wayfinder Family Services is not responsible for lost, stolen, or damaged personal belongings, except as otherwise required by law.

Transportation Authorization

When transportation is provided as part of an Activity, I authorize the Participant to be transported by Wayfinder Family Services employees, volunteers, contractors, or approved transportation providers. I understand that transportation may include travel in Wayfinder-owned, rented, contracted, or other approved vehicles and agree that the participation, assumption-of-risk, and release provisions above also apply to such transportation.

2. MEDICAL AUTHORIZATION AND EMERGENCY TREATMENT CONSENT

In the event of illness, injury, or a medical or dental emergency, Wayfinder Family Services will make reasonable efforts to contact the Participant, parent, guardian, authorized representative, or emergency contact when circumstances permit.

If the appropriate person cannot be reached promptly, or if immediate care is reasonably necessary, I authorize Wayfinder Family Services to obtain emergency medical, dental, surgical, ambulance, hospital, or other healthcare treatment for the Participant as recommended by licensed healthcare providers or emergency responders.

I authorize Wayfinder Family Services to provide relevant health, medication, allergy, accessibility, and emergency information to healthcare providers and emergency responders when necessary for the Participant’s care.

I understand that the Participant, or the Participant’s parent, guardian, conservator, or authorized representative, is financially responsible for any medical, dental, transportation, hospital, ambulance, or related expenses incurred on behalf of the Participant.

3. MEDIA RELEASE

I grant Wayfinder Family Services permission to photograph, video record, audio record, and otherwise capture the Participant’s image, likeness, voice, statements, and participation during Activities.

I authorize Wayfinder Family Services to use, reproduce, edit, publish, display, distribute, and archive these materials in publications, websites, social media platforms, presentations, marketing materials, fundraising materials, donor communications, grant applications and reports, news and media communications, and other organizational materials, without compensation.

I understand that these materials may be publicly distributed and may remain in use indefinitely.

For individual profile stories containing personal information or direct quotations, Wayfinder Family Services will obtain additional verbal or written approval before publication.

4. MEDIATION AND BINDING ARBITRATION AGREEMENT

I agree that any unresolved dispute, claim, or controversy arising out of or relating to the Participant’s registration, attendance, participation in Activities, services provided by Wayfinder Family Services, or these agreements shall first be submitted to non-binding mediation before a mutually agreed-upon neutral mediator.

If mediation does not fully resolve the dispute, the unresolved matter shall be submitted to final and binding arbitration before a neutral arbitrator in accordance with applicable California law.

The arbitrator shall have authority to award any relief available under applicable law. Arbitration costs and fees shall be allocated in accordance with applicable law and the arbitrator’s decision.

I understand that by agreeing to binding arbitration, I am waiving the right to have covered disputes decided by a judge or jury in a court of law.

If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
